STEP ONE: $250.00 I will
prepare and serve a Summons & Complain for Unlawful Detainer on the tenant.
The tenant will have 7 days to respond to my office in writing. If the tenant
vacates the property in within 7 days then MISSION ACCOMPLISHED with no further
legal costs to you! If not Go to Step Two
STEP TWO: $450.00 or $650.00
If the tenant fails to respond to the Summons within 7 days of service and
has not vacated the property, I will then obtain a Default Judgment from the
Court (usually the next day.) The Clerks office will then issue a Writ
of Restitution restoring the property to you. The Sheriff will usually serve
the Writ of Restitution on the tenant the next day with an instruction to
vacate the property usually within 7 days. If the tenant still has not vacated
the property when the Sheriff returns, then the Sheriff will stand by as you
the Landlord remove the tenants possessions. If the tenant interferes,
then Sheriff will arrest the tenant. TOTAL COST FOR THE DEFAULT JUDGMENT&
WRIT OF RESTITUTION - $450.00 OR...

If the tenant does respond to the Summons
& Complaint for Unlawful Retainer within 7 days of service, then a mandatory
Show Cause hearing is scheduled. At the hearing, if the Commissioner determines
that there are no disputed facts, the Court will issue a Judgment in favor
of the Landlord instructing the Clerk to issue a Writ of Restitution.
TOTAL COST FOR THE SHOW CAUSE HEARING, JUDGMENT & WRIT OF RESTITUTION
- $650.00

If the tenant does not avail himself to personal services,
then a court order permitting service by posting & mail may be obtained
for $200.00. If the tenant has not vacated the property by
the time the Sheriff services the Writ of Restitution, then the Landlord is
charged a standby fee by the Sheriffs Office. If you the
Landlord does not prevail at the Show Cause hearing because the Court has
determined that a factual dispute exists between you and the tenant, I can
be hired to represent you at trial for $2000.00.
